The ATO’s latest playbook for SMSF education directions

Running a self‑managed superannuation fund (SMSF) gives you greater control over your retirement savings, but it also means you are responsible for meeting strict compliance obligations. When things go wrong, ATO education directions are becoming an increasingly important part of the regulator’s approach.

What is an SMSF education direction?

An education direction is essentially the ATO’s way of sending SMSF trustees “back to school” after a breach of the superannuation rules. Rather than immediately imposing heavy penalties, the ATO can require a trustee to complete an approved course covering their trustee responsibilities.

When will the ATO issue an education direction?

You may receive an education direction where:

• your SMSF has breached superannuation rules
• the ATO believes a lack of knowledge contributed to the breach
• the contravention was not deliberate, malicious or fraudulent
• you have not previously received an education direction

This reflects the ATO’s view that education is most useful where gaps in understanding led to the mistake, rather than deliberate non‑compliance.

Common SMSF contraventions

Education directions are often triggered by issues such as:

• loans or financial assistance to members
• accessing superannuation benefits early
• breaching investment restrictions
• failing to keep fund assets separate from personal assets

What happens if you don’t comply?

If you receive an education direction, you must:

• complete the approved education course within the specified timeframe
• provide evidence of completion to the ATO
• sign or re‑sign your SMSF trustee declaration within 21 days

Failure to comply can result in penalties of up to 10 penalty units, which may amount to several thousand dollars, and may lead to more serious consequences such as trustee disqualification.

When education directions won’t apply

The ATO will not offer education directions in all cases. Trustees who are repeat offenders, experienced professionals who should reasonably know their obligations, or individuals involved in serious or deliberate breaches are more likely to face stronger enforcement action instead.

Importantly, even if you were not directly involved in the breach, you may still receive an education direction if you were a trustee at the time. All SMSF trustees are jointly responsible for compliance.
